Kullanım Koşulları

Bu koşullar, Ginowl (bireysel geliştirici Yiğit Samet Ölmez) tarafından sunulan Roachy mobil uygulamasının kullanımını düzenler. Uygulamayı kullanarak bu koşulları kabul etmiş olursun. İletişim: disciplifydeveloper@gmail.com

1. Hizmet

Roachy, yazdığın metni yapay zeka ile konuşan bir karakter videosuna dönüştürür. Videolar yapay zeka tarafından üretilir; sonuç her zaman yazdığın gibi ya da beklediğin gibi olmayabilir. Hizmeti geliştirmek için özellikleri değiştirebilir, ekleyebilir ya da kaldırabiliriz.

2. Yaş ve hesap

Uygulamayı kullanmak için en az 18 yaşında olmalısın; 18 yaşından küçükler Roachy'yi kullanamaz. Hesabının güvenliğinden ve hesabınla yapılan işlemlerden sen sorumlusun.

3. Abonelik ve ödemeler

• Video üretmek için abonelik gerekir. Ücretsiz deneme ya da ücretsiz video yoktur.
• Abonelik, seçtiğin plana göre haftalık ya da yıllık olarak otomatik yenilenir. Güncel fiyatlar satın alma ekranında gösterilir. Ödeme, satın alma onaylandığında App Store ya da Google Play hesabından alınır.
• Aboneliği, dönem bitmeden en az 24 saat önce App Store ya da Google Play hesap ayarlarından iptal etmezsen otomatik yenilenir. İptal, içinde bulunduğun dönemin sonunda geçerli olur.
• Abonelikle günde 2 video, ayda en fazla 30 video üretebilirsin. Aboneliğin başladığı ayda aylık sınır, abone olduğun günden ay sonuna kadar kalan gün sayısıyla orantılıdır. Günlük hak, abone olduğun saatte yenilenir; kullanılmayan hak ertesi güne devretmez.
• Ek video paketleri günlük ve aylık sınırın üzerine eklenir, süresi dolmaz ve yalnızca aboneliğin aktifken kullanılabilir.
• Teknik bir hata nedeniyle üretilemeyen videonun hakkı otomatik olarak iade edilir. İçerik kurallarına takılan üretimlerde hak iade edilmez.
• İade talepleri Apple ya da Google'ın iade politikalarına tabidir ve ilgili mağaza üzerinden yapılır. Tüketici mevzuatından doğan hakların saklıdır.

4. İçerik kuralları

Uygulamayı kullanırken şunları yapmamayı kabul edersin:

• Cinsel içerik, çıplaklık ya da çocukları içeren her türlü uygunsuz içerik üretmek,
• Hukuka aykırı, tehdit eden, bir kişiyi hedef alarak taciz eden ya da kişilik haklarını ihlal eden içerik üretmek,
• Gerçek bir kişiyi, yapmadığı bir şeyi yapıyor ya da söylemediği bir şeyi söylüyormuş gibi gerçek sanılacak biçimde göstererek insanları yanıltmak,
• Başkalarının telif, marka ya da diğer fikri mülkiyet haklarını ihlal etmek,
• Uygulamanın güvenlik önlemlerini, kullanım sınırlarını ya da ödeme sistemini atlatmaya çalışmak, uygulamayı otomatik araçlarla kullanmak.

Yazdığın metinlerden ve ürettiğin videoların nasıl kullanıldığından sen sorumlusun. Uygunsuz içeriğe ve kötüye kullanıma hiçbir şekilde tolerans göstermeyiz: bu kurallara uymayan üretimleri engelleyebilir, kaldırabilir ve bunları üreten hesabı kapatabiliriz.

5. Ürettiğin videolar

Ürettiğin videoları kişisel olarak kullanabilir ve sosyal medyada paylaşabilirsin. Videoda yer alan marka, logo, isim ya da kişilere ilişkin üçüncü taraf haklarından sen sorumlusun. Hizmeti sunmak için (videoyu üretmek, saklamak ve sana göstermek) videolarını ve metinlerini işlememize izin vermiş olursun.

5a. Keşfet

Ürettiğin videolar, hazır olduklarında otomatik olarak uygulamanın Keşfet bölümünde diğer kullanıcılara anonim olarak (kim ürettiği görünmeden) gösterilir; videonun yanında onu üreten metin de görünür. Bunun için bize, videonu ve metnini uygulama içinde göstermek üzere ücretsiz, dünya çapında ve münhasır olmayan bir izin verirsin. Bu izin, videoyu Keşfet'te gizlediğinde (video detayında "…" → Keşfet'te gizle) ya da hesabını sildiğinde sona erer.

Keşfet'teki videoları diğer kullanıcılar izleyebilir, cihazlarına kaydedebilir ve paylaşabilir; metni kendi videoları için örnek olarak kullanabilir. Videonu gizlemen, gizlemeden önce kaydedilmiş ya da paylaşılmış kopyaları geri almaz. Keşfet'te görünmesini istemediğin bir şeyi üretmeden önce bunu göz önünde bulundur.

6. Şikayet

Uygunsuz ya da hatalı bir videoyu uygulama içinden "Bildir" ile bildirebilirsin. Bildirilen video Keşfet'ten hemen kalkar. Bildirimleri en geç 24 saat içinde inceleriz; içerik kurallara aykırıysa kalıcı olarak kaldırır ve onu üreten hesabı kapatırız. Bir videonun üreticisini engelleyebilirsin; engellediğin üreticinin videoları sana bir daha gösterilmez.

7. Sorumluluğun sınırlandırılması

Hizmet "olduğu gibi" sunulur. Kesintisiz ya da hatasız çalışacağını garanti etmeyiz. Yasaların izin verdiği ölçüde, uygulamanın kullanımından doğan dolaylı zararlardan sorumlu değiliz. Zorunlu tüketici hakların bu maddeden etkilenmez.

8. Fesih

Hesabını istediğin an silebilirsin (Hesap silme). Bu koşulları ihlal etmen durumunda hesabını askıya alabilir ya da kapatabiliriz. Hesabın kapanması mağazadaki aboneliğini iptal etmez.

9. Değişiklikler ve uygulanacak hukuk

Bu koşulları güncelleyebiliriz; önemli değişikliklerde uygulama içinden bilgilendiririz. Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır.

10. Apple kullanıcıları

Uygulamayı App Store'dan indirdiysen Apple'ın Standart Lisans Sözleşmesi de geçerlidir. Apple bu uygulamanın bakımından ve desteğinden sorumlu değildir.

These terms govern your use of the Roachy mobile app, provided by Ginowl (individual developer Yiğit Samet Ölmez). By using the app you agree to them. Contact: disciplifydeveloper@gmail.com

1. The service

Roachy turns the text you write into an AI-generated video of a talking character. Results are generated by AI and may not always match what you wrote or expected. We may change, add or remove features.

2. Age and account

You must be at least 18 years old; Roachy may not be used by anyone under 18. You are responsible for your account and activity on it.

3. Subscriptions and payments

• A subscription is required to generate videos. There is no free trial and no free video.
• The subscription renews automatically every week or every year, depending on the plan you choose, at the price shown on the purchase screen, charged to your App Store or Google Play account.
• It renews unless cancelled in your store account settings at least 24 hours before the end of the current period; cancellation takes effect at the end of that period.
• Subscribers can generate 2 videos per day, up to 30 per month. In the month you subscribe, the monthly limit is prorated to the days remaining. The daily allowance resets at the hour you subscribed and does not roll over.
• Add-on video packs are added on top of these limits, never expire, and can only be used while your subscription is active.
• If a video fails for a technical reason, the allowance is refunded automatically. Generations blocked by content rules are not refunded.
• Refunds are handled by Apple or Google under their policies. Your statutory consumer rights are not affected.

4. Content rules

You agree not to: create sexual content, nudity, or any inappropriate content involving minors; create unlawful or threatening content, or content that targets and harasses a person or violates their personal rights; deceive people by realistically depicting a real person doing or saying something they did not; infringe copyrights, trademarks or other intellectual property; or try to circumvent security measures, usage limits or payments, or use the app with automated tools. You are responsible for your text and for how you use your videos. We have zero tolerance for objectionable content and abuse: we may block or remove content that breaks these rules and close the accounts that create it.

5. Your videos

You may use your videos personally and share them on social media. You are responsible for any third-party rights (brands, logos, names or people) appearing in them. You allow us to process your text and videos as needed to provide the service.

5a. Discover

Once ready, your videos are automatically shown to other users in the app's Discover section anonymously (without showing who made them), together with the text behind them. You grant us a free, worldwide, non-exclusive permission to display your video and its text in the app for this purpose. This permission ends when you hide the video from Discover (open the video → "…" → Hide from Discover) or delete your account.

Other users can watch Discover videos, save them to their device and share them, and use the text as an example for their own videos. Hiding your video does not recall copies saved or shared before you hid it. Keep this in mind before creating something you would not want to appear in Discover.

6. Reports

You can report an inappropriate or faulty video in the app. A reported video is removed from Discover immediately. We review reports within 24 hours; if the content breaks the rules, we remove it permanently and close the account that created it. You can also block a video's creator; videos from creators you block are no longer shown to you.

7. Limitation of liability

The service is provided "as is", without guarantees of uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect damages. Mandatory consumer rights remain unaffected.

8. Termination

You can delete your account at any time (Account deletion). We may suspend or close accounts that violate these terms. Closing an account does not cancel a store subscription.

9. Changes and governing law

We may update these terms and will notify you in the app of significant changes. These terms are governed by the laws of the Republic of Türkiye.

10. Apple users

If you downloaded the app from the App Store, Apple's Standard License Agreement also applies. Apple is not responsible for maintenance or support of this app.
